Families USA’s Comments on “Affordability of Coverage for Family Members of Employee” (the so-called “family glitch”)

Families USA commented in support of a proposed federal rule to fix the so-called “family glitch.” Under current rules, employer-sponsored coverage is considered affordable to a family based on the employee’s cost of self-only coverage, even if coverage for the whole family is unaffordable. We commented that this is contrary to the goals of the Affordable Care Act and is an incorrect interpretation of the statute. The Internal Revenue Service’s proposed rule, “Affordability of Employer Coverage for Family Members of Employees,” will address this problem.
