Families USA Comments on “21st Century Cures Act: Establishment of Disincentives for Health Care Providers That Have Committees Information Blocking” Proposed Rule

12.22.2023

Families USA submitted comments to the Center for Medicare and Medicaid Services on their proposed rule to establish disincentives for certain providers who participate in the practice of health information blocking. Families USA supports the proposal to implement financial penalties for health care providers engaging in data blocking and increase transparency into the actors participating in data blocking. The comment letter expands on the following additional recommendations:

  • Administer corrective action plans prior to administering financial penalties.
  • Protect patient privacy for sensitive health care data- including information related to abortions, sexual and reproductive, and gender affirming care.
